Malaysia Consumer Store

 

Thanks for shopping at Motosing. We appreciate the fact that you like to buy the cool stuff we build. We also want to make sure you have a rewarding experience while you’re exploring, evaluating, and purchasing our products, whether you’re at the Motosing Online Store or on the phone with the Motosing Contact Center. (To make it visually easier on both of us, we’ll refer to these entities as the “Motosing Store” in this policy.)

As with any shopping experience, there are terms and conditions that apply to transactions at an Motosing Store. We’ll be as brief as our attorneys will allow. The main thing to remember is that by placing an order or making a purchase at an Motosing Store, you agree to the terms set forth below along with Motosing’s Privacy Policy and Terms of Use.

 

Standard Return Policy

 

We fundamentally believe you will be thrilled with the products you purchase from the Motosing Store. That’s because we go out of our way to ensure that they’re designed and built to be just what you need. We understand, however, that sometimes a product may not be what you expected it to be. In that unlikely event, we invite you to review the following terms related to returning a product.

For Motorcycle returns, you may not return your motorcycle. 

 

For any other undamaged product (not purchased in volume), simply return it with the original receipt (or gift receipt) and original packaging with unused condition within 7 days from the date you received the product. If the item is returned within this timeframe, we’ll exchange it upon the original payment method. We will only refund if the item is broken by Motosing when sold. However, please note that we will only remit refunds to a Malaysian bank account where the name of the bank account holder matches the payor’s name/information.  Please also note that we only remit refunds domestically and cannot remit refunds outside of Malaysia. Please note the following:

 

Return of Products Purchased in Volume

 

In addition to the Standard Return Policy, the following applies to returns of any product purchased in volume (aggregate of more than 4 per order or across multiple orders) from the same product category:

Must be returned within 7 days of the date you receive the product;

Will be subject to a 25% restocking fee per item; and

Must be returned to the Apple Store where originally purchased.

Pricing and Price Reductions/Corrections

 

With regards to pricing, Motosing reserves the right to change prices for products displayed at/on the Motosing Store at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the Payment & Security page.

Should Motosing reduce its price on any Motosing-branded product within 14 calendar days from the date you receive your product, feel free to contact the Motosing Contact Center at +60-122250128. Order Acceptance/Confirmation For Online and Call Center Purchases

Once we receive your order, we’ll provide you with an email order confirmation. Your receipt of an order confirmation, however, does not signify Apple’s acceptance of your order, nor does it constitute confirmation of our offer to sell; we are simply confirming that we received your order. The Motosing Store reserves the right at any time after receiving your order to accept or decline your order for any reason. If Motosing cancels an order after you have already been billed, Motosing will refund the billed amount.

 

Shipping & Delivery

 

Please review the Shipping & Pickup page to learn about how and when you will receive the products you purchased from the Motosing Store. Since the actual delivery of your order can be impacted by many events beyond Motosing’s control once it leaves our facilities, Motosing cannot be held liable for late deliveries. We will, however, work with you to ensure a smooth delivery.

As Motosing takes care of the dispatch of the products you purchase on the Motosing Store, the risk of loss of, or damage to, product(s) shall pass to you when you, or a person designated by you, acquires physical possession of the product(s). Title in the product(s) shall pass to you when the product(s) is picked up by the carrier from our warehouse. At this point, you will receive the Shipment Notification Email. If there are any issues with delivery, please contact Motosing to resolve. 

In-Store Pickup and Return

Motosing offers in-store pickup for many of the items available on the Online Store. Certain products and payment methods, however, may not qualify for in-store pickup. Only you or the person designated by you may pick up the item(s) purchased. A government-issued photo ID and order number will be required for pickup. Motosing will notify you when your order is ready and the date by which you need to pick up your items. We’ll also send you a reminder or two, just in case it slips your mind. Pickup Contact

 

If you select in-store pickup, you may designate a third party to pick up your order. You must provide the name and email address of the third party. Please note that certain products and payment methods are not eligible for in-store pickup by a third party. The third party will need to bring a government issued photo ID and order number for pickup. Apple is not responsible for actions taken by the third party once your item(s) have been picked up.

 

Consumers Only

 

The Motosing Store sells and ships products to end-user customers only. You may not purchase products at the Apple Store for resale, and we reserve the right to refuse or cancel your order if we suspect you are doing so. And we’re pretty good at figuring that out . . .

 

Malaysia Sales Only

 

The Motosing Store accepts orders from billing addresses within Malaysia. Motosing will not ship products purchased at the Motosing Store to an address outside of Malaysia.

 

Product Availability and Limitations

 

Given the popularity and/or supply constraints of some of our products, Motosing may have to limit the number of products available for purchase. Trust us, we’re building them as fast as we can. Motosing reserves the right to change quantities available for purchase at any time, even after you place an order. Furthermore, there may be occasions when Motosing confirms your order but subsequently learns that it cannot supply the ordered product. In the event we cannot supply a product you ordered, Motosing will cancel the order and refund your purchase price in full.

 

Privacy policy 

 

Motosing’s Privacy Policy describes how Motosing collects, uses, and shares your personal data.

 

Personal Data

  1. As used in this Policy:“member” means a member of the Law Society of Singapore, whether practising or otherwise;  “customer” means an individual who (a) has contacted us through any means to find out more about any goods or services we provide, or (b) may, or has, entered into a contract with us for the supply of any goods or services by us; and “personal data” means data, whether true or not, about a customer who can be identified: (a) from that data; or (b) from that data and other information to which we have or are likely to have access.

 

  1. Depending on the nature of your interaction with us, some examples of personal data which we may collect from you include name, residential address, email address and telephone number. 

 

  1. Other terms used in this Policy shall have the meanings given to them in the PDPA (where the context so permits).

 

Collection, Use and Disclosure of Personal Data

  1. We generally do not collect your personal data unless (a) it is provided to us voluntarily by you directly or via a third party who has been duly authorised by you to disclose your personal data to us (your “authorised representative”) after (i) you (or your authorised representative) have been notified of the purposes for which the data is collected, and (ii) you (or your authorised representative) have provided written consent to the collection and usage of your personal data for those purposes, or (b) collection and use of personal data without consent is permitted or required by the PDPA or other laws. We shall seek your consent before collecting any additional personal data and before using your personal data for a purpose which has not been notified to you (except where permitted or authorised by law).

 

We may collect and use your personal data for any or all of the following purposes:

 

(a) operating our website and/or its subdomains (“Website”);(b) performing our statutory functions and administering our activities; (c) communicating with our members and customers; (d) updating your personal and contact information; (e) performing obligations in the course of or in connection with our provision of the goods and/or services requested by you; (f) verifying your identity; (g) responding to, handling, and processing queries, requests, applications, complaints, and feedback from you; (h) managing your relationship with us; (i) processing payment or credit transactions; (j) complying with any applicable laws, regulations, codes of practice, guidelines, or rules, or to assist in law enforcement and investigations conducted by any governmental and/or regulatory authority; (k) statistical, analysis, planning and reporting; (l) any other purposes for which you have provided the information; and (m) any other incidental purposes related to or in connection with the above.

 

  1. This Policy does not apply to aggregated information which summarises statistical information about groups of members, and which does not include name, contact information, or any other information that would allow any particular individual to be identified.

 

  1. We may disclose your personal data:

 

(a) where necessary to enforce the Terms of Use; (b) where such disclosure is required for performing obligations in the course of or in connection with our provision of the goods and services requested by you; (c) to third party service providers, agents and other organisations we have engaged to perform any of the functions with reference to the above mentioned purposes; (d) if required by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal processes served on us or the Website; (b) protect and defend our rights or property; and (c) act under exigent circumstances to protect the personal safety of users of the Website; or (e) where your consent has been obtained for disclosure.

 

  1. Where your use of the Website is concerned, you acknowledge and accept that certain functions, when activated or used by you, will operate to send or display information about yourself, including but not limited to, your personal data to certain third parties, and you agree to the sharing of such information with these third parties. You acknowledge and agree that we shall not be held responsible or accountable for any loss, injury or damage sustained by you for sharing the aforesaid information arising out of your activation or use of such features on the Website.

 

Withdrawing Your Consent

  1. The consent that you provide for the collection, use and disclosure of your personal data will remain valid until such time it is being withdrawn by you in writing. You may withdraw consent and request us to stop collecting, using and/or disclosing your personal data for any or all of the purposes listed above by submitting your request in writing or via email to our Data Protection Officer at the contact details provided below.

 

  1. Upon receipt of your written request to withdraw your consent, we may require reasonable time (depending on the complexity of the request and its impact on our relationship with you) for your request to be processed and for us to notify you of the consequences of us acceding to the same, including any legal consequences which may affect your rights and liabilities to us. In general, we shall seek to process your request within ten (10) business days of receiving it.

 

  1. Whilst we respect your decision to withdraw your consent, please note that depending on the nature and scope of your request, we may not be in a position to continue providing our goods or services to you and we shall, in such circumstances, notify you before completing the processing of your request. Should you decide to cancel your withdrawal of consent, please inform us in writing in the manner described in clause 9 above.

 

  1. Please note that withdrawing consent does not affect our right to continue to collect, use and disclose personal data where such collection, use and disclose without consent is permitted or required under applicable laws.

 

Access to and Correction of Personal Data

  1. If you wish to make (a) an access request for access to a copy of the personal data which we hold about you or information about the ways in which we use or disclose your personal data, or (b) a correction request to correct or update any of your personal data which we hold about you, you may submit your request in writing or via email to our Data Protection Officer at the contact details provided below.

 

  1. Please note that a reasonable fee may be charged for an access request. If so, we will inform you of the fee before processing your request.

 

  1. We will respond to your request as soon as reasonably possible. In general, our response will be within thirty (30) business days. Should we not be able to respond to your request within thirty (30) days after receiving your request, we will inform you in writing within thirty (30) days of the time by which we will be able to respond to your request. If we are unable to provide you with any personal data or to make a correction requested by you, we shall generally inform you of the reasons why we are unable to do so (except where we are not required to do so under the PDPA).
